Cut with Surface between two planes

I'm wondering how I can remove the middle part of a 3D model (see the attachment, I want to remove the hatched part that is between two planes)! If I use "Cut with surface", I'll lose the upper or lower part (part1 or part2)! Any ideas!:tired:

You can just draw an oversized box on plane 1 and extrude cut to the second plane.
